Emirates NBD only discloses your Personal Data outside of Emirates NBD in limited circumstances. If Emirates NBD does share the Personal Data outside of Emirates NBD, we will put in place appropriate controls and data sharing/processing agreements that require recipients to protect your Personal Data, unless Emirates NBD is legally required to share that Personal Data. All contractors or recipients that work for Emirates NBD will be obliged to follow Emirates NBD instructions. Emirates NBD does not sell your Personal Data to third parties.

Emirates NBD only discloses your Personal Data outside of Emirates NBD in limited circumstances. If Emirates NBD does share the Personal Data outside of Emirates NBD, we will put in place appropriate controls and data sharing/processing agreements that require recipients to protect your Personal Data, unless Emirates NBD is legally required to share that Personal Data. All contractors or recipients that work for Emirates NBD will be obliged to follow Emirates NBD instructions. Emirates NBD does not sell your Personal Data to third parties.

Emirates NBD may disclose your Personal Data to Emirates NBD third-party Service providers, agents, and subcontractors (Suppliers) for the purposes of providing Services to us or directly to you on Emirates NBD’s behalf.

When Emirates NBD uses Suppliers, Emirates NBD only discloses to them the Personal Data that is necessary to provide their Services and only where Emirates NBD has a contract in place which requires them to keep your Personal Data secure and not to use it other than in accordance with Emirates NBD’s specific instructions.

Emirates NBD take steps to ensure that any third-party service providers who handle your Personal Data comply with the Applicable Laws and protect your Personal Data to the same extent that Emirates NBD does. This type of processing allows us to ensure that the intermediary or broker is fulfilling the terms of their contract with us and for us to fulfil our legal and regulatory obligations.
Performance of a Contract

Emirates NBD websites and apps are intended for use only by persons who are above the age of 13. If you are under the age of 13, your parent or guardian must consent on your behalf where Emirates NBD asks for consent in relation to the use of your Personal Data.

The way Emirates NBD analyses Personal Data relating to Emirates NBD Services may involve profiling or other automated methods to make decisions about you that relate to the following:

  • Credit and affordability checks (including credit limits) – Emirates NBD will consider several factors including information about your income, expenses and how well you have kept up on payments in the past.
  • Anti-money laundering, sanctions checks and screening 'politically exposed' people.
  • Monitoring your account for fraud and other financial crime – Emirates NBD will assess your transactions to identify any that are unusual.
  • Assessments required by regulators and appropriate authorities – certain details in your information may suggest that you are likely to become financially vulnerable and Emirates NBD may need to help you.

You may have a right to certain information about how Emirates NBD make these decisions. You may also have a right to request human intervention in case it pertains to a fully automated process and to challenge the decision. Emirates NBD needs your Personal Data to provide you with the Services or products requested by you. Emirates NBD also needs to capture expressed consent to be able to process the Personal Data for fulfilling Emirates NBD’s contractual and legal obligations.

If you do not provide us with the requested Personal Data, Emirates NBD may have to decline your request for our Product(s) and/or Service(s), or if Emirates NBD is already providing you with the product(s) and Service(s), Emirates NBD may need to suspend or stop providing you with the product(s) or Service(s), which can lead to closure of your banking relationship with us, subject to compliance with Emirates NBD’s legal obligations to retain data.

It is voluntary for you to provide us your Personal Data or consent for direct sales or marketing purposes.

ENBD makes it clear on the ENBD physical application forms, during your onboarding digitally and on all communications received from the Bank as to what data is required to be provided by you by marking the mandatory fields with the asterisk symbol (*). Emirates NBD collects Personal Data about your internet activity using technology known as cookies, which can often be controlled through internet browsers and by using Emirates NBD cookie preference centre on the Emirates NBD website.

Emirates NBD is a global organisation, and your Personal Data may be stored, transferred or processed in any country where Emirates NBD has facilities or in which Emirates NBD engages Service providers and subcontractors. In doing so, Emirates NBD will comply with the PDPA and other applicable data protection and privacy laws. Emirates NBD has put in place appropriate safeguards in accordance with applicable legal and data protection requirements to ensure that your data is adequately protected.

You have certain rights in respect of your Personal Data, and Emirates NBD have processes to enable you to exercise these rights. Your rights are as follows:

  • Opt Out / Unsubscribe: You can request to be removed from the Emirates NBD marketing mailing list, from the unsubscribe button in the email itself, or by contacting your Wealth Advisor.
  • Right to Access (also known as a ‘Individual Access Request’): You have the right to obtain confirmation as to whether Emirates NBD processes Personal Data about you, receive a copy of your Personal Data held by us, and obtain certain other information about how and why Emirates NBD processes your Personal Data.
  • Right to Correction: You have the right to request for your Personal Data to be amended or rectified where there is an error or omission (for example, if you change your name or address) and to have incomplete Personal Data completed. Emirates NBD may take a reasonable period after receiving your correction request to process and update the change.
  • Right to Withdraw Consent: Where Emirates NBD process Personal Data based on consent, individuals have a right to withdraw their consent at any time. To do so, please use the contact details below in the “How to Contact Us” section.
  • Right to Lodge a Complaint with a Supervisory Authority: Emirates NBD sincerely hope that you will never need to, but if you do want to complain about our use of Personal Data, please send an email with the details of your complaint using the contact details set out below. You may lodge a complaint with the supervisory authority in your country of residence, place of work or the country in which an alleged infringement of data protection law has occurred. Please note, all rights are subject to qualifications and limitations. In other words, there may be instances and justifiable grounds to deny any request where Emirates NBD are required or permitted by law to do so. The Security of your Personal Data is important to us. We make every effort to ensure that your Personal Data is secure on our system. Emirates NBD has staff dedicated to maintaining the Emirates NBD security standards as set forth herein. Emirates NBD implements technical and organisational measures to ensure a level of security appropriate to the risk to the personal information Emirates NBD processes. These measures are aimed at ensuring the on-going integrity and confidentiality of personal information. Your Emirates NBD profile is password-protected so that only you and authorised Emirates NBD employees have access to your account information. Emirates NBD staff will never reach out to you and ask for any personal account information, including your password.

Whilst Emirates NBD takes measures to secure your Personal Data, risks to data security do exist, and there is always a possibility of unauthorised use, disclosure, modification and/or destruction of your Personal Data. In the event of a Personal Data Breach where Emirates NBD has assessed it to be notifiable, Emirates NBD will notify you about it and its likely consequences, measures taken by us to mitigate the increased risk and avenues available to you to mitigate the risk as a result of the Personal Data Breach.

Emirates NBD will keep your Personal Data for as long as Emirates NBD has a relationship with you. Once the Emirates NBD relationship with you has come to an end, Emirates NBD will retain your Personal Data for a period that enables us to:

  • Maintain business records for analysis and/or audit purposes.
  • Comply with record retention requirements under the law.
  • Defend or bring any existing or potential legal claims.

Emirates NBD will delete your Personal Data when it is no longer required for these purposes. If there is any information that Emirates NBD is unable, for technical reasons, to delete entirely from Emirates NBD systems, we will put in place appropriate measures to prevent any further processing or use of the data.

Term Definition
Anonymisation Means the process of removing direct personal identifiers that may lead to an individual being identified or re-identifiable.
Anonymous Data Means any information relating to a natural person where the person cannot be identified whether by the Organization or by any other person, taking account of all the means reasonably likely to be used either by the Organization or by any person to identify that individual.
Applicable Law(s) Means all Applicable Law(s) or regulations in Singapore in which Services are provided or received, which relate to the collection, disclosure, use or processing of personal data, personally identifiable data, or privacy, including the Personal Data Protection Act 2012 (No. 26 of 2012 of Singapore).
Authority(ies) Means legal, supervisory, regulatory, governmental, and quasi-governmental bodies such as the Monetary Authority of Singapore, the Personal Data Protection Commission (“PDPC”), fraud prevention agencies, tax authorities etc.
Automated Processing Means Processing that is conducted using an electronic application or system that operates automatically, either independently without any human intervention or under the supervision and limited intervention of a human.
Biometric Data Means Personal Data resulting from specific technical processing relating to the physical, physiological and behavioural characteristics of the Individual, which allow the identification or confirm the unique identification of the Individual, such as facial recognition images.
Consent Means the Consent by which the Individual authorises Emirates NBD or third parties to process their Personal Data, provided that such Consent is freely given, informed, clear, specific, and unambiguous indication of the Individual’s agreement, by a statement or by a clear affirmative action, to the Processing of their Personal Data.
Cookies Means text files created on a client computer when its web browser loads a website or web application. Often encrypted for protection against unauthorised access, they are used to store information for performing certain functions such as completing forms, facilitating website navigation, authentication, and enabling advertising technology.
Data Breach(es) Means, as per the Singapore Personal Data Protection Act 2012, the unauthorised access, collection, use, disclosure, copying, modification or disposal of personal data; or the loss of any storage medium or device on which personal data is stored in circumstances where the unauthorised access, collection, use, disclosure, copying, modification or disposal of the personal data is likely to occur.
Organization (“Data Controller”) Means organizations’ which collect, use, or disclose personal data. It covers any individual, company, association, or body of persons, corporate or unincorporated, whether or not they are formed or recognized under the law of Singapore or are resident or have an office or place of business in Singapore.
Data Intermediary Means means an organisation which processes personal data on behalf of another organisation but does not include an employee of that other organisation.
Data Protection Officer (DPO) Means any natural or legal person appointed by the Controller or the Processor who undertakes responsibilities to verify that the entity he belongs to complies with the Personal Data Protection controls, requirements, procedures, and rules provided for herein, and to verify the integrity of its systems and procedures to achieve the compliance with the provisions hereof.
Data Protection Regulator Means any governmental or regulatory body or authority with responsibility for monitoring or enforcing Applicable Law(s).
Data Transfer(s) Means the transfer of data from one jurisdiction to another.
Destruction of Personal Data Means Personal Data no longer exists.
Emirates NBD Means Emirates NBD Bank (P.J.S.C)
Encryption Means the process of encoding information stored on a device and can add a further layer of security. It is considered an essential security measure where Personal Data is stored on a portable device or transmitted over a public network.
Existing Customer Individuals who have a history of purchasing or hiring any goods or using any services provided by Emirates NBD.
Individual Access Request Means a request to receive a copy of one's data from the Bank. Such requests are limited to information that is specific and limited to that one individual.
Individuals Means a natural person, whether living or deceased to whom the Personal Data relates to.
Individuals Right(s) Means the set of rights afforded to individuals, as per Applicable Data Protection Law(s), who request information about the Personal Data collected or stored by Emirates NBD and to exert choice or control over how that data is used by Emirates NBD in accordance with Applicable Data Protection Law(s).
Individuals Rights Request Means specific rights that individuals may exercise depending on the jurisdiction they are based in and the maturity of their local data protection laws. Such legislation bestows on individuals several rights that they may exercise.
Know Your Customer or KYC Means mandatory requirements to ensure updated information about Emirates NBD’s Customers, to perform identity verification and prevention of illegal transactions through the business relationship with Emirates NBD such as money-laundering, identity theft.
Loss of Personal Data Means that the Controller has lost control or access to the Personal Data.
Monetary Authority of Singapore (MAS) Means the Central Bank of Singapore.
Personal Data Means any data, whether true or not, about an individual who can be identified – (a) from that data, or (b) from that data and other information to which the organisation has or is likely to have access.
Processing Means the carrying out of any operation or set of operations in relation to the personal data, and includes but not limited to, any of the following: recording, holding, organisation, adaptation, alteration, retrieval, combination, transmission, erasure or destruction.
Profiling Means a form of Automated Processing consisting of the use of Personal Data to evaluate certain personal aspects relating to an Individual.
Prospective Customer An individual who informs or has informed Emirates NBD of his interest in its goods or services. The level of interest includes subscription to a mailing list and extends to requests for information concerning specific goods or services. This also includes an individual who conducts or is conducting negotiations to purchase or hire or use any goods or use of services provided by Emirates NBD. Negotiations can range from exploratory discussions to negotiations with a view to conclude an agreement.
Pseudonymisation Means the processing of Personal Data in such a manner that the Personal Data can no longer be attributed to a specific Individual without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the Personal Data are not attributed to an identified or identifiable natural person.
Sensitive Personal Data Means the processing of data of those deemed to be vulnerable individuals such as minors, individuals with physical or mental disabilities, or other special needs. Sensitive data may include the following: an individual's national identification numbers (e.g. National Registration Identity Card and passport numbers); personal data of a financial nature (e.g. bank account details, Central Depository account details, securities holdings, transaction and payment summaries); insurance information (e.g. names of the policyholder's dependents or beneficiaries, sum insured under the insurance policy, the premium amount and type of coverage); an individual's personal history involving drug use and infidelity; sensitive medical conditions; and personal data of minors.
Additionally, in the Breach Notification Regulations, the PDPC prescribes a list of data that, if subject to a data breach, would be deemed to result in significant harm to individuals. These include the following broad categories of personal data:
  • Financial information which is not publicly disclosed.
  • Personal data which would lead to the identification of vulnerable individuals (e.g. leading to the identification of a minor who has been arrested for an offence).
  • Life, accident, and health insurance information which is not publicly disclosed.
  • Specified medical information.
  • Information related to adoption matters.
  • Private keys used to authenticate any or digitally sign an electronic record or transaction.
  • An individual's account identifier and data for access into the Individual's account.
Singapore Data Protection Act Means the Personal Data Protection Act 2012 (No. 26 of 2012 of Singapore).
Staff Means full time employees and contractors of Emirates NBD.
Supervisory Authority

Means the local data protection regulators who are responsible for overseeing data protection compliance within a given jurisdiction.

Such regulators are responsible for, but not limited to the following:

  • Monitoring and enforcing data protection compliance
  • Prepare key guidance documents
  • Proposing and approving codes of practice
  • Investigate complaints made by Individuals
  • Preparing guidance

The supervisory authority in Singapore is the Info-communications Media Development Authority designated as the Personal Data Protection Commission (“PDPC”).
